1. Agreement to Terms

By accessing and using SmartX Traders ("the Platform"), you accept and agree to be bound by and comply with these Terms of Service and our Privacy Policy. If you do not agree to abide by the above, please do not use this service.

SmartX Traders reserves the right to update, change, or replace any part of these Terms at any time. Continued use of the Platform following the posting of revised Terms means you accept and agree to the changes.

2. Account Registration & Eligibility

To use SmartX Traders, you must be at least 18 years of age and legally capable of entering into contracts. You agree to provide accurate, current, and complete information during the registration process.

• You must not be a resident of any country under US or international sanctions
• You must not use the Platform for any illegal or unauthorized purpose
• You are responsible for maintaining the confidentiality of your account credentials
• You are liable for all activities that occur under your account

3. Risk Disclosure

Trading in financial markets carries substantial risk of loss. Trading on margin increases these risks. You acknowledge that:

• Trading is highly speculative and risky
• Past performance does not guarantee future results
• You may lose your entire investment
• Leverage can amplify both gains and losses
• Market volatility may result in rapid price changes
• Technical failures may prevent order execution

Only risk capital you can afford to lose. Do not trade with borrowed funds unless you fully understand the risks involved.

4. Account Restrictions & Prohibited Activities

You agree not to:

• Engage in market manipulation, spoofing, or layering
• Use automated trading systems without proper licensing
• Attempt to gain unauthorized access to the Platform
• Use the Platform for money laundering or terrorist financing
• Share your account with third parties
• Engage in fraudulent or deceptive trading practices
• Violate any local, national, or international laws
• Attempt to circumvent KYC/AML requirements

5. Trading Rules & Order Execution

All trades executed on SmartX Traders are subject to the following rules:

• Orders are executed on an "as available" basis
• SmartX Traders reserves the right to reject or modify orders
• Minimum order size and lot requirements apply
• Spread and slippage may apply during high volatility
• Stop losses and take profits are not guaranteed execution prices
• Weekend and holiday gaps may result in order execution at different prices

6. Fees, Charges & Commissions

SmartX Traders charges the following fees:

• Trading Commissions: Charged per round-trip trade
• Spreads: Variable based on market conditions
• Overnight Charges: Interest on margin positions held overnight
• Inactivity Fees: May apply to dormant accounts
• Withdrawal Fees: May apply depending on payment method

All fees are clearly displayed before order confirmation. SmartX Traders reserves the right to modify fees with 30 days' notice.

7. Deposits & Withdrawals

You acknowledge and agree that:

• Deposits must originate from an account in your name
• We accept payment methods as specified on the Platform
• Withdrawal requests are processed within 5 business days
• Funds are returned to the original payment method
• We reserve the right to verify the source of funds
• Suspicious transactions may be flagged and investigated

8. Limitation of Liability

To the fullest extent permitted by law, SmartX Traders shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Trading losses or poor market performance
• Third-party actions or unauthorized access to your account
• Technical failures or service interruptions
• Force majeure events beyond our reasonable control

Our total liability shall not exceed the fees paid to SmartX Traders in the preceding 12 months.

9. Intellectual Property Rights

All content on SmartX Traders, including software, designs, text, graphics, and logos, is the exclusive property of SmartX Traders or its licensors. Unauthorized reproduction or distribution is prohibited.

10. Dispute Resolution & Arbitration

Any disputes arising from these Terms or use of the Platform shall be resolved through binding arbitration in accordance with international arbitration rules, rather than in court. Each party waives the right to a jury trial.

11. Privacy & Data Protection

Your use of SmartX Traders is governed by our Privacy Policy. We collect and process personal data as necessary to provide services and comply with regulatory requirements. See our Privacy Policy for details.

12. Regulatory Compliance

SmartX Traders complies with all applicable financial regulations, including:

• Know Your Customer (KYC) requirements
• Anti-Money Laundering (AML) regulations
• Market Abuse Regulation (MAR) compliance
• International sanctions screening

13. Account Termination

SmartX Traders reserves the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Violate AML/KYC requirements
• Reside in a prohibited jurisdiction
• Are subject to international sanctions

Upon termination, you may withdraw remaining funds less any outstanding charges.
